Welcome to Brandova (“Brandova”, “we”, “us”, or “our”).
These Terms of Service (“Terms”) govern your access to and use of the Brandova website, platform, and services (collectively, the “Service”).
By accessing or using Brandova, you agree to be legally bound by these Terms. If you do not agree, you must not use the Service.
1. Description of the Service
Brandova is an AI-powered Software-as-a-Service (SaaS) platform that enables users to generate:
AI-generated product mockups,
advertising banners,
promotional images,
video advertisements with voiceovers and music,
from a single product image and/or text prompt.
No physical production, filming, or manual design is required.
2. Eligibility
You must be at least 18 years old (or the legal age in your jurisdiction) to use the Service.
By using Brandova, you confirm that you have the legal authority to enter into this agreement.
3. Account Registration
Certain features require account creation.
You agree to:
provide accurate, current, and complete information,
maintain the confidentiality of your login credentials,
accept responsibility for all activities under your account.
Brandova is not responsible for any unauthorized access resulting from your failure to protect your credentials.
4. Plans, Pricing & Credits
Brandova may offer free trials, credit-based plans, or subscription plans.
Credits are non-transferable and have no cash value.
Unused credits may expire depending on your plan.
Prices and features may change at any time and will be displayed prior to purchase.
5. Payments & Stripe
5.1 Payment Processing
All payments are processed securely through Stripe, a third-party payment processor.
By purchasing any paid Service, you agree to be bound by the Stripe Services Agreement, available at:
https://stripe.com/legal/ssa
Stripe may collect and process personal and financial data in accordance with applicable laws, including KYC, AML, and Strong Customer Authentication (SCA) requirements.
5.2 Authorization
By providing payment details, you authorize Brandova and Stripe to charge:
one-time fees, and/or
recurring subscription fees (if applicable),
according to the selected plan.
5.3 Refund Policy
Unless otherwise stated:
all payments are final and non-refundable,
no refunds for unused credits or partial subscription periods.
Refunds may be issued only where legally required or at Brandova’s sole discretion.
6. User Content
6.1 Uploaded Content
You retain ownership of all images, text, or materials you upload (“User Content”).
By uploading content, you grant Brandova a worldwide, non-exclusive, royalty-free license to use, process, reproduce, and modify such content solely to operate and provide the Service.
6.2 Prohibited Content
You may not upload content that:
infringes intellectual property rights,
is illegal, fraudulent, or misleading,
contains adult, hateful, or violent material,
violates advertising laws or third-party platform policies.
Brandova reserves the right to remove content or suspend accounts at its sole discretion.
7. AI-Generated Content Disclaimer
Brandova uses artificial intelligence to generate visual and video content.
You acknowledge that:
AI-generated results may vary and are not guaranteed,
outputs may contain inaccuracies or imperfections,
you are solely responsible for ensuring compliance with advertising, branding, and legal requirements before commercial use.
8. Commercial Use
Unless explicitly restricted by your plan, generated content may be used for commercial purposes, including advertising, marketing, websites, and social media.
Brandova does not guarantee performance, engagement, conversion rates, or sales results.
9. Intellectual Property
All software, AI models, interfaces, branding, logos, and platform content are the exclusive property of Brandova and are protected by applicable intellectual property laws.
You may not copy, reverse engineer, resell, sublicense, or exploit the Service without prior written consent.
10. Suspension & Termination
Brandova may suspend or terminate your access at any time if:
you violate these Terms,
required by law or regulation,
Stripe suspends or restricts payment services related to your account.
You may stop using the Service at any time.
11. Limitation of Liability
To the maximum extent permitted by law, Brandova shall not be liable for:
indirect, incidental, or consequential damages,
loss of profits, revenue, data, or business opportunities,
service interruptions or AI output errors,
actions or failures of third-party services, including Stripe.
The Service is provided “as is” and “as available.”
12. Indemnification
You agree to indemnify and hold harmless Brandova, its officers, affiliates, and partners from any claims, damages, or liabilities arising from:
your use of the Service,
your User Content,
your violation of these Terms or applicable laws.
13. Changes to the Terms
Brandova may update these Terms at any time.
Continued use of the Service after changes constitutes acceptance of the updated Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
